Terms of Service

Effective 30 September 2026 · Applies to the United States

The short version. CacheOut publishes probability estimates for football games. It is not betting advice and not a sportsbook — we take no bets and hold no money. CacheOut is free: there are no paid plans and nothing to cancel. We sell some of your data and you can stop that at any time. We do not promise you will win anything. The full text below controls.

1. Agreement

These Terms are a contract between you and CacheOut LLC, a Delaware limited liability company (“CacheOut”, “we”). By creating an account or using the service you agree to them. If you do not agree, do not use the service. Our Privacy Policy is part of this agreement.

2. What this is

CacheOut estimates the probability of outcomes in American football and publishes those estimates before kickoff, then grades them in public afterwards. It also sends in-play alerts when a published call is strongly winning while the game is still running.

CacheOut is not a sportsbook. We take no bets, hold no funds and are not licensed to accept wagers anywhere. Every exit, deposit and withdrawal happens at a book you choose.

Everything here is information and analysis. It is not betting advice, not a tipping service, and not financial, investment, legal or tax advice. An alert reports a position; it does not tell you what to do about it. A call published at 80% is expected to lose about one time in five, and does.

You alone decide whether to place, keep or cash out any wager, and you bear the entire result. 21+ where permitted. Play responsibly.

3. Who may use it

You may use the service only if all of the following are true:

  • You are at least 18, and at least 21 if you intend to bet where 21 is the minimum.
  • You are located in the United States. We do not offer the service in the European Economic Area, the United Kingdom or Switzerland, and signups from those regions are refused.
  • Sports betting information is lawful where you are.
  • You have not previously been removed from the service.

It is your responsibility to know the law where you live. Using a VPN or otherwise misstating your location to obtain access is a breach of these Terms.

4. Your account

Keep your password secret and your email address current; you are responsible for what happens under your account. One account per person. Do not share, sell or transfer access, and do not redistribute what you see inside it — a seat is for you.

Tell us at once if you believe someone else has access.

5. Price

CacheOut is free. There are no paid plans, no trials and no card to give us, and we will never charge you without first asking for, and getting, your agreement. If we ever introduce a paid option, we will email you at least 30 days beforehand, and the free service you signed up for does not turn into a paid one on its own.

6. Closing your account

You can stop using CacheOut at any time, and there is nothing to cancel. Alerts stop from your account or the unsubscribe link in any alert, and you can ask us to delete your account and its data as the Privacy Policy describes.

7. Your data

We sell some of your personal information. Specifically your email address, your plan tier, and your account status and dates — to third parties, for payment. We never sell your password, your payment details, your messages or your activity logs. You can stop it at any time, free, without signing in and without giving a reason, and nothing about your access changes if you do: Do Not Sell or Share My Personal Information.

The Privacy Policy sets out exactly what we hold, why, who receives it, and every right you have over it. Read it before you agree to these Terms.

8. Acceptable use

Do not:

  • Scrape, crawl or bulk-extract the boards, the record, or any data behind the seat.
  • Republish, resell or redistribute our estimates, alerts or written calls.
  • Share your account, or use one account for several people.
  • Reverse-engineer, probe or interfere with the service, or attempt to bypass the gate.
  • Use the service to break the law where you are, or to facilitate anyone else doing so.
  • Present our output as your own, or imply we endorse you.

9. Our content

The models, probabilities, written calls, record, alerts, copy and design are ours or our licensors’. While you have an account you have a personal, non-transferable, revocable licence to use them for your own private purposes. Nothing else is granted.

Underlying sports data comes from third-party feeds and belongs to those providers. Team and league names belong to their owners; we are not affiliated with, endorsed by or sponsored by any league, team or sportsbook.

10. No warranty

The service is provided “as is” and “as available”, with no warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.

We specifically do not warrant that:

  • Any prediction, probability or alert will prove correct.
  • You will profit, or avoid loss. Most people who bet lose money over time.
  • The service will be uninterrupted, or that data will be timely or accurate. Live scores and probabilities reach us from third-party feeds in batches and can run minutes behind reality; an alert can arrive after the moment it describes has passed.
  • Past results indicate future results. They do not.

11. Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost winnings, gambling losses, or losses arising from a delayed, missed or inaccurate alert — whether or not we were told such losses were possible.

Our total liability for any claim is limited to the amount you actually paid us in the 12 months before it arose.

Some states do not allow the exclusion of certain warranties or liabilities, so parts of this section may not apply to you. Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited.

12. Indemnity

You will indemnify CacheOut LLC against any claim, loss or cost arising from your use of the service, your breach of these Terms, or your breach of any law — including any gambling law of the place you were in when you used it.

13. Termination

You may stop at any time by closing your account. We may suspend or end your access if you breach these Terms, if we are required to, or if we stop offering the service. Sections 7 and 9 through 14 survive.

14. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Any dispute will be brought in the state and federal courts located in Delaware, and we each consent to that jurisdiction.

If any provision is held unenforceable, the rest continues in force. Our failure to enforce a provision is not a waiver of it.

15. Changes

We may update these Terms. Material changes will be emailed to members at least 30 days before they take effect, and continuing to use the service afterwards means you accept them. If you do not, you may close your account.
